General information
Cake 0 Emission AB, corporate registration number 559014-2682, a corporation duly organized and validly existing under the laws of Sweden, hereinafter referred to as CAKE, is a manufacturer and developer of electric motorbikes, components and associated gear. CAKE may sometimes refer to as ‘us’ in the Terms and Conditions.
General terms and conditions are meant to regulate our users at ridecake.com. Their validity extends to future transactions with CAKE as well as visits to ridecake.com. The right to revise terms and conditions remains with CAKE. Users are requested to keep themselves updated with changes by checking the updated dates placed at the end of terms and conditions.
ridecake.com at times performs and concerns with services mediated by outside organization. In such cases, CAKE acts as an intermediary therefore not responsible for errors resulting from those organization activities. CAKE is not liable for damages arising from using the site or not- for any damaged caused by using the site or for that matter not being able to use the site. Like any business, CAKE can’t promise a website free of problems and some security concerns.
Violation of rules
CAKE seeks justice in the event of violation of the terms and conditions. Therefore, persons found guilty of any offense concerning the preserved rights are prosecuted.
Violation of terms and conditions grants CAKE the right to look for law and equitable remedies that may involve restricting the offender right to access the site. Violating password-protected area may call for court charges.
CAKE Trademarks
CAKE trademarks include CAKE font, CAKE logo, CAKE logo and typo, CAKE components, trailsavers and CAKE Ace. Clients are advised to use these materials for personal use but not for commercial purposes. Provided the copyright permission notice is included in the documents, clients may download, print, and store copies of the materials for personal use. No charging, no publishing, no transmit or distribution without permission from CAKE is allowed. No modification in any way of the material without documented permission from the owner. Exceptional cases would be in line with the legal notice of no rights or licenses to the article, or any portion thereof shall be granted or implied. Force Majeure
The contract between CAKE and you is not permanent and can be terminated by either party. The force factors may take the form of civil wars, government regulations, industrial unrest, and electricity failure amongst other factors not forgetting natural disasters that are beyond the firm’s control. In the event of such unavoidable circumstances, CAKE’s obligations are put off and try our level best to solve the matter generally and as quick as possible.
Governing Law
CAKE works and operate within the Swedish laws. Therefore, a client should agree to involve Swedish courts to decide during any conflict. There might be a disparity in laws between your country and Sweden which then may require you to understand the Swedish legal requirement before using the website. Clients should, therefore, comply with local as well as international laws and regulations concerning using the website.
All personal information saved at Ridecake.com will be handled with most care.
Clients’ personal information is highly confidential, and no third parties have access to them other than Ridecake.com and the client. The personal information saved will be used only to ensure the client gets the full good services provided by the Ridecake.com. The information will be for informing the clients about the special offers offered by ridecake.com as well as marketing activities.
Third party access to clients’ personal information is only after high necessity to fulfill the above-described purposes. Clients have the option not to be notified by CAKE during registration to the website.

To request the kind of information kept in the system, one may send a request email to order@Ridecake.com. In case of any complaint regarding the information, an individual has the right to have the information deleted or corrected. Customers using cards for payment are conditioned for validity checks. CAKE, therefore, has the right to hold orders in case of security concerns.
Purchase, payment & pricing
Payment of Deposit and Full Payment for purchase of our electric motorbikes
Deposit: 500USD/EUR secures an order. The balance is paid upon shipment.
Orders from US & Canada are shipped from CAKE warehouse in Salt Lake City, UT, USA.
Orders from rest of the world are shipped from our global warehouse in Rotterdam, The Netherlands.
Final payment is invoiced upon delivery. When the payment is received by CAKE the order will be shipped to customers address.
Payment & Pricing
Accepted payment methods are by Visa, MasterCard,Amex, PayPal and Maestro Full amount is charged with dispatching the item.
The currency depends on the items is being delivered/purchased to/from.
USA & Canada
Orders destined for USA and Canada are shipped from the local warehouse in Utah to the nearest collection point before using ground shipping for final delivery.
For these collections, it takes around ten to fourteen working days for delivery.
Additional fees may be added depending on the country/state. Currency for payments is US-dollars.
European Union
All CAKE products will in countries belonging to the EU be delivered DDP, Delivered Duty Paid, accordingly to Incoterms 2010 to the address of the buyer.
Orders within the European Union are shipped using ground shipping. Delivery takes approximately five to seven working days for CAKE's electric motorbikes and less for other products. Currency for payments is EUROS.
Switzerland, Norway and Iceland
Orders to Switzerland, Norway and Iceland will be shipped DAP, Delivered At Place, accordingly to Incoterms 2010. This means that we do not collect VAT.
Prices are adjusted to make the overall cost for customers the same for orders in Switzerland, Norway and Iceland and countries within the European Union where the VAT is included in the price.
Orders are shipped using ground shipping. Delivery takes approximately five to seven working days for CAKE's electric motorbikes and less for other products. Currency for payments is EURO.
Rest of the world
Orders to other countries than those mentioned above will be shipped DAP, Delivered At Place, accordingly to Incoterms 2010. This means that we do not collect VAT, duties and/or taxes on orders and we cannot predict what your particular charges may be.
If you do get such additional charges they must be paid in order for your package to clear customs. Please contact your local customs office for more information.
For these collections, it takes around fifteen working days for delivery. Other fees may be added depending on the country.
Shipping & delivery
Shipping of CAKE's electric motorbikes
CAKE will keep the customer updated on preliminary date of shipping and send a notification when a bike is ready to be shipped.
Shipping zones – motorbikes
Depending on your delivery address the cost of your shipping has a fixed price.
Zone 1. Every address in USA & Canada: 350$
Zone 2. Austria, Denmark, Germany, Belgium, Luxembourg, Netherlands: 200€
Zone 3: France, Italy, Sweden, Liechtenstein, Poland, Czech Republic, Slovakia, Switzerland: 300€
Zone 4: Iceland, Norway, Bulgaria, Cyprus, Estonia, Finland, Greece, Ireland, Croatia, Latvia, Lithuania, Malta, Portugal, Romania, Slovenia, Spain, United Kingdom, Hungary: 400€
Zone 5: Asia, Africa, South America and Australia: 1500$
No delivery to post office boxes due to restrictions by courier services and credit card scam risks. Sending orders to multiple addresses require placing an order for each address. No combination are possible and there will be charges for every order

Splitit instalments
Purchasing through Splitit has the same terms and conditions as any other purchase at ridecake.com. The ‘as low as pricing’ is based on maximum installment time (36 months) divided om lowest priced equipment on each bike model.
The as low as pricing includes the fixed arrangement cost: Arrangement cost 12 Months: Only +2,75% Arrangement cost 24 Months: Only +5,5% Arrangement cost: 36 Months: Only +8,25%

Uncollected items
No refunding of shipping costs for failed collection of items.

CAKE is temporarily unable to have tracking information automatically emailed for your order.

Delivery Schedule
Although CAKE will make efforts to begin delivering your electric motorbike or other product as soon as reasonably practicable, you understand and agree that there may be delays.
An estimated time of delivery (ETD) is only an estimate and subject to change. CAKE does not guarantee that it will be able to ship the CAKE bike by the estimated date.
As a result, in the event that a delay arises and the estimated shipment and/or release of the CAKE electric motorbike is not met, CAKE is not responsible for any damages that may occur due to the delay, nor shall it be obligated, to provide any discounts, refunds or credits due to any such delays. CAKE will provide you periodical updates with information regarding the delivery schedule.
Priority of CAKE's electric motorbikes delivered
If Final Payment has been received at the same time as another buyer has paid his or hers Final Payment, the buyer that paid his or hers Deposit first is considered first of the two and will be prioritized in delivery of the CAKE electric motorbike.
Oversubscription of electric motorbikes
CAKE may decline Payment of Deposit to avoid oversubscription of CAKE's electirc motorbikes. If your Payment of Deposit is declined, you will be notified and your Deposit will be refunded, in the same currency as paid.
The Customer acknowledge that he or she is at least 18 years old and eligible to enter into a legal contract with CAKE.
Cancellation period of Payment of Deposit
You as a buyer has the right to cancel the Deposit of a CAKE bike and be refunded in the same currency as paid by contacting order@ridecake.com within 14 (fourteen) days after the date of payment of the Deposit.
Full Payment consists of the Deposit consisting of 500 (Five Hundred) USD/EUR and the Final Payment balancing the set price of the bike in USD/EUR.
Transfer of deposit
The Deposit can be transferred to another person than the buyer if a written message from the buyer is delivered to CAKE. CAKE needs to accept this in writing and full information of the new buyer has to be given to CAKE.
Registration
When paying the Deposit for the electric motorbike, you will be required to provide certain information, such as your address and billing information. It is your responsibility that all such information is accurate, and you shall ensure that such information is kept current.
CAKE shall have no responsibility or liability for inaccurate information that later becomes outdated. CAKE shall have no obligation to make efforts to determine the correct contact or shipping information.

Disclaimer
There is a risk for colors and displayed errors at the website.
Actual colors may vary. This is due to the fact that every computer monitor has a different capability to display colors and that everyone sees these colors differently.
We try to edit our photos to show the samples as life-like as possible, but please understand the actual color may vary slightly from your monitor. We cannot guarantee that the color you see accurately portrays the true color of the product.
All details such as specifications and manufacturing brand are subject to changes. Changed parts will always be an equal product as stated earlier.
Lights such as the headlight, blinkers and more are subject to change based on local regulations around the world, that means that lights shown in pictures might be different on delivered products.
Written errors can occur from the human factor, third party information, or broken integrations, codes or automatic updates.
CAKE tries its best to display free of error texts, images, stock, as well as prices, for products, shipping in the site and web shop. If your order would have an error such as the payment, product, quantities, don’t worry, please email us at order@ridecake.com to solve and adjust the error for all parties.
CAKE, doesn’t warranty uncertainties caused by these errors. Moreover, CAKE cannot guarantee that all content is updated since they can be altered at any time.
Disclaimer & Limitation of Liability
Our bikes can be hazardous to operate and we care about your safety, so please note that;
✓ All riders should ride well within the limits of their abilities, never beyond them.
✓ Our electric motorbikes are recommended for those aged 18 years and older.
✓ Have the license the bike require.
✓ We recommend that all riders take a relevant training course.
✓ Make sure that you ride on a permitted area. Always follow your local regulations.
✓ Always wear a certified DOT helmet, eye protection and protective clothing, including an approved back protector.
✓ Never carry passengers if the motorbike is registered for only 1 rider
✓ Never engage in stunt riding.
✓ Never ride in conjunction with alcohol or drugs. It is illegal and dangerous.
✓ Avoid excessive speed and be particularly careful on difficult terrain.
✓ Don’t modificate your bike. All modifications and installations are at your own risk.
✓ Never change the voltage level or tamper with the battery. Doing so can result in a short circuit, fire and/or personal injuries.
✓ By purchasing and/or riding our bikes, you take full responsibility for any use, and/or misuse of the product and agree that Cake 0 Emission AB holds no responsibility for any consequences, legal, or other, of such use and/or misuse.
✓ Finally, read the owner’s manual carefully, follow all instructions therein and enjoy your CAKE electric motorbike!
Returns & Exchanges
Within 14 days following the purchase of the items, you are permitted to exchange or return the items.
The order must be returned to us in perfect condition in the original packaging and accompanied by the original invoice.
The original packaging must be fully intact for the return to go through well. CAKE cannot accept returns where labels have been removed or tampered with in any way.
Shipping charges on returned items are at the customer’s expense.
For refunding, clients will wait for a fortnight before getting their money back to the original credit card of the purchaser. Additional duties or taxes and shipping cost will not be refunded.
The inclusion of VAT for countries within the EU will be done in the refund.
Exchanges are only valid when the products are in existence. Same type and size of the product, as well as availability, will guarantee the exchange of faulty items.
Faulty items refund will be within a month period of delivery. The exchange is guaranteed as per the instructions from CAKE. Stores cannot initiate return and refund of items.
The following are the procedure to follow when returning the item. How to proceed with a return:
Kindly contact order@Ridecake.com for how to go through with the whole process of your return. Restate your order number. Furthermore, clarify which items you are sending back, and stating clearly why you wish to return them.
Return instructions
• Return of an item requires possession of a return authorization (RA) number; without which there will be no acceptance of the returned item.
• To poses a return authorization, contact us via email using the information illustrated below:

• To return a package, you should inform us within a month since the day the package was received. CAKE has no responsibility resulting from damage or loss of the item since we recommend you insure the item via logistics and keep tracking number until complete refund has been done.
• Returned item should be in untouched condition with original tags placed on the package.
• The packaging of the manufacturer should be visible either in writing or marks.
• The customer is responsible for the return shipping costs, and other extra costs.CAKE will only call for return when there was shipment error in this case we cater for such expenses.
Warranty & complaints
CAKE offers a Limited Warranty to the original buyer of a CAKE electric motorcycle. The Limited Warranty will only be valid provided a receipt and/or invoice can be presented at the time of the warranty claim.
CAKE warrants that all factory manufactured CAKE motorcycles are free from defects in material and workmanship during the period of this Limited Warranty.
This Limited Warranty covers separate parts only, including battery, motor, controller, frame, front and rear suspension, brakes, wheels and electrical sub-assemblies. The Limited Warranty does not cover against damages caused by normal wear and tear. For parts that easily wear out, such as drive chains, drive belts, seats, grips, rims, lights / lamps, tires, brake levers, bearings etc., the Limited Warranty is only valid as long as the bike is not used.
The Limited Warranty is only valid provided that the CAKE motorcycle has been operated according to “proper use” and “under normal operating conditions”, e.g. following normal operational care and following instructions in any manual or documentation provided, or made available, by CAKE from time to time.
The Limited Warranty does not apply in the event of crashes, damages, abuse, neglect, carelessness, using the product in any way other than intended, replacement with any part or accessory other than original CAKE parts and products, attempt of reparation or modification unless expressly permitted in writing by CAKE.
Any modification to the CAKE motorcycles, or riding with damaged parts, will deem the Limited Warranty null and void, as modifications and broken parts can cause the motorcycles to malfunction and risk the safety of the rider.
The period for which this Limited Warranty is valid is defined as:
• 24 months from the original shipment date, or date of purchase through retailer, for all warranty included parts, excluding batteries, on all CAKE street legal bikes that have not been used in off-road applications
• 6 months from the original shipment date, or date of purchase through retailer, for all warranty included parts, excluding batteries, on all CAKE non-street legal bikes and CAKE street-legal bikes that have been used in off-road applications
• 24 months from the original shipment date, or date of purchase through retailer, for batteries, where batteries are subject to warranty (subject to the limitations listed above) in case of a battery capacity loss of 30% or more
All warranty claims should be processed through Cake 0 Emission AB by filling this form https://ridecake.com/en/service-support/. If applicable we will process the warranty through your authorized dealer or local CAKE service point.
In the United Kingdom all warranty obligations and standards are followed according to the ‘Plug-in Motorcycle Grant Vehicle application form and guidance notes Version 2.1’.
This limited warranty does not cover any incidental or consequential damages, including loss of value of the cake motorcycle, lost profits or earnings, out-of-pocket expenses for substitute transportation or lodging, expenses associated with returning the covered product to an authorized service facility or dealer, towing and/or roadside assistance expenses, expenses associated with returning the covered product back to its owner, mechanic’s travel time or communication charges, loss or damage to personal property, loss or time, or inconvenience.
Privacy policy
CAKE is responsible for personal data related to the services. However, other processors or co-responsible parties can act with personal data.
“Personal Data” means any and all information, which can be directly or indirectly linked, to a living natural person.
We strive to maintain a high level of protection of personal privacy. CAKE uses personal data primarily to administer, provide, develop and maintain the services, process your reservations, optimize your experience with respect to the services and individualize the communication with you.
Please read this Privacy Policy carefully to understand how and for what purposes we process your Personal Data.
By providing your Personal Data to us and accepting the applicable terms and conditions, you consent to your Personal Data being processed in accordance with the provisions set forth in the separate terms and conditions for each Service and this Privacy Policy.
If a more specific consent is required from you by law, we will of course ask you for such specific consent.
This Privacy Policy together with Terms and Conditions, CAKE’s Cookie Policy and any other separate terms and conditions governing CAKE’s processing of Personal Data from time to time, are together referred to as the “Privacy Terms”.
The Privacy Terms state the basis for the manner in which we process Personal Data that you provide to us when you use the Services or that we collect regarding you.
Thus, with respect to some of our Services, there are also separate terms and conditions for the processing of Personal Data that you accept when you use each Service.
Changes to this Privacy Policy are announced by the new terms and conditions being published on CAKE’s websites and we therefore recommend that you regularly review these.
If you add Personal Data regarding other people, you are responsible for ensuring that CAKE may also process that Personal Data in accordance with the applicable Privacy Terms.
Collection and processing of personal data
CAKE collects and processes your Personal Data only where permitted by law. The collection and processing may take place when you use the services.
We use various methods to collect Personal Data such as cookies, web beacons, customer surveys and membership services. At various times, CAKE compiles or imports Personal Data from databases (e.g. from Facebook or Google) within and outside CAKE. From time to time we receive Personal Data regarding you from companies within CAKE, cooperation partners and other information that may be added to your profile (if a profile has been created).
It is important for CAKE to keep your Personal Data up to date and accurate at all times. That is why we may import Personal Data about you from external sources such as public registers.
When the law requires that consent be obtained for the processing of certain types of Personal Data or for certain forms of processing, consent will be obtained from you before processing takes place.
By proceeding to the checkout to buy an item the information typed in, in the checkout columns is saved as long as the information is useful for CAKE or when the customer wants the information deleted.
Useful cases are eg: abandoned shopping carts that occurs because of technical issues, unexpected situations in the surroundings in conjunction when placing the order or when the customer have questions before the item(s) is bought and don’t find the answer. Therefore will we try our best to follow up and give the customer best possible service to help them placing an order if they’re interested. Information from and about you that we collect and process
We only collect Personal Data relevant for the purpose described in the separate terms and conditions for each Service and this Privacy Policy.
The information we may collect is, for example, information regarding name, address, telephone number, email address, IP address, information to facilitate the use of the Services (such as login), default language, user history, payments and other information you provide when using the Services.
Examples of Personal Data collected from companies outside CAKE may include, updated address information and demographic information.
